These Terms and Conditions govern your use of the TableFlow platform, operated by Coetzee Data AI Consultants Pty (Ltd) (Reg. 2025/428324/07). By accessing or using TableFlow — whether as a restaurant owner, restaurant staff member, or dining customer — you agree to be bound by these Terms. If you do not agree, do not use the platform.

Definitions

In these Terms, the following definitions apply:

  • "TableFlow" means the QR-based restaurant ordering and payment platform operated by Coetzee Data AI Consultants Pty (Ltd).
  • "Platform" means the TableFlow website, web application, and all associated services accessible via QR code or URL.
  • "Restaurant" or "Merchant" means any food service business that has registered to use TableFlow to accept orders and payments.
  • "Customer" means any individual who accesses the Platform via QR code to browse a menu, place an order, or make a payment.
  • "Operator" means Coetzee Data AI Consultants Pty (Ltd), the owner and operator of TableFlow.
  • "Subscription" means the monthly fee paid by Restaurants to access the TableFlow platform.
  • "Order" means a food or beverage order placed by a Customer via the Platform.

Eligibility & Age Restriction

You must be at least 18 years of age to use the TableFlow platform. By accessing or using the Platform, you confirm that you are 18 years of age or older. The Operator reserves the right to terminate access for any user who is found to be under 18 years of age.

Restaurant accounts may only be registered by authorised representatives of legitimate food service businesses registered to operate in their jurisdiction.

Nature of the Platform

TableFlow is a technology platform that provides restaurants with tools to accept digital orders and payments from customers via QR code. The Operator is not a party to any transaction between a Customer and a Restaurant. Specifically:

  • The Operator does not prepare, store, handle, or deliver food or beverages.
  • All food and beverage orders are fulfilled exclusively by the Restaurant.
  • The contract for the supply of food and beverages is between the Customer and the Restaurant only.
  • The Operator acts solely as a technology intermediary and is not responsible for the quality, safety, or accuracy of any food or beverage served.

Important: TableFlow is a technology service provider. Any dispute regarding food quality, incorrect orders, or service issues must be directed to the Restaurant, not to TableFlow.

Restaurant Obligations

By registering as a Restaurant on the Platform, you agree to:

  • Provide accurate and up-to-date menu information, pricing, and descriptions.
  • Honour all orders placed through the Platform in a timely and professional manner.
  • Maintain all required business licences, health certificates, and permits required by South African law or the law of your operating jurisdiction.
  • Handle all customer complaints, refund requests, and disputes relating to orders directly and in accordance with these Terms and your own refund policy.
  • Keep your payment gateway credentials secure and notify the Operator immediately if you suspect unauthorised use.
  • Pay your monthly subscription fee on or before the due date specified on your invoice.
  • Not use the Platform for any unlawful, fraudulent, or misleading purpose.
  • Comply with the Protection of Personal Information Act 4 of 2013 (POPIA) with respect to any customer data you access via the Platform.

Customer Obligations

By using the Platform as a Customer, you agree to:

  • Provide accurate payment information when placing an order.
  • Only place orders you intend to honour and pay for.
  • Direct any complaints, concerns, or refund requests to the Restaurant directly.
  • Not attempt to reverse, dispute, or chargeback a payment fraudulently.
  • Not misuse the Platform in any way that could damage, disable, or impair its operation.
  • Confirm that you are 18 years of age or older before using the Platform.

Payments

All meal payments made through the Platform are processed via third-party payment gateways (including Ozow and others). By making a payment, you agree to the terms and conditions of the relevant payment gateway.

  • The Operator does not store your card details or banking credentials.
  • Payment processing is subject to the policies of the relevant payment gateway.
  • The Operator is not responsible for payment failures, delays, or errors caused by the payment gateway or your bank.
  • All prices displayed on the Platform are in South African Rand (ZAR) unless otherwise stated.
  • Restaurant subscription fees are payable monthly by electronic funds transfer (EFT) to the Operator's nominated bank account.

Subscription & Access Control

Restaurant access to the Platform is contingent on payment of the applicable monthly subscription fee. The following access control policy applies:

  • New Restaurants receive a 30-day free trial from the date of registration.
  • After the trial period, a monthly subscription fee is due as per your selected plan.
  • If payment is not received by the due date, a 7-day grace period is granted during which the Platform remains accessible.
  • If payment is not received within the grace period, access to the Platform will be automatically suspended. Customers will be unable to place orders through the Restaurant's TableFlow interface.
  • Access is restored within 24 hours of payment being confirmed by the Operator.
  • The Operator reserves the right to terminate a Restaurant's access permanently for repeated non-payment or breach of these Terms.

Note: The Operator will send reminder notifications before suspending access. It is the Restaurant's responsibility to ensure payment is made on time.

Intellectual Property

All intellectual property rights in the Platform — including but not limited to software, design, trademarks, logos, and content — are owned by or licensed to Coetzee Data AI Consultants Pty (Ltd). You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Platform without the Operator's prior written consent.

Restaurants retain ownership of their own menu content and branding uploaded to the Platform. By uploading content, you grant the Operator a non-exclusive licence to display that content on the Platform for the purpose of providing the service.

Limitation of Liability

To the maximum extent permitted by South African law:

  • The Operator shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform.
  • The Operator is not liable for any loss arising from food quality, incorrect orders, food-borne illness, or any matter within the Restaurant's control.
  • The Operator is not liable for payment gateway failures, banking delays, or third-party service interruptions.
  • The Operator's total liability to any party shall not exceed the subscription fees paid by that party in the three months preceding the claim.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg.

The Operator encourages parties to resolve disputes amicably in the first instance by contacting us at info@coetzeedataconsultants.co.za.

Changes to These Terms

The Operator reserves the right to update these Terms at any time. Restaurants will be notified of material changes via email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

Coetzee Data AI Consultants Pty (Ltd) ("we", "us", "the Operator") is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and all applicable South African privacy legislation. This policy explains how we collect, use, store, and protect your personal information when you use the TableFlow platform.

What Personal Information We Collect

We collect personal information in two contexts — from Restaurant owners/staff and from Customers using the ordering platform.

From Restaurant owners and staff:

  • Full name and contact details (email address, phone number)
  • Company name and registration number
  • Banking details for EFT subscription payments
  • Login credentials (email and encrypted password)
  • Payment gateway credentials (stored encrypted)

From Customers placing orders:

  • Table number and order details
  • Payment information processed via third-party payment gateways (we do not store card numbers)
  • Device type and browser information (for technical purposes only)
  • Order history associated with a session

Important: Customer orders via QR code do not require account registration. We do not collect names or email addresses from Customers unless voluntarily provided.

How We Use Your Information

We process personal information only for the following lawful purposes:

  • To provide and operate the TableFlow platform and its features
  • To process and fulfil orders placed through the platform
  • To generate and send subscription invoices to Restaurants
  • To manage Restaurant accounts, access control, and subscriptions
  • To communicate important service updates, policy changes, or account notifications
  • To comply with our legal obligations under South African law
  • To improve the platform and resolve technical issues

We do not sell, rent, or share your personal information with third parties for marketing purposes.

Data Storage & Security

Your personal information is stored securely on Supabase, a cloud database platform. Data is stored on servers located in the European Union (Ireland). Supabase complies with international data protection standards including ISO 27001 and SOC 2 Type II.

We implement the following security measures:

  • All data is encrypted in transit using TLS (HTTPS)
  • Data at rest is encrypted using AES-256
  • Access to the database is restricted by Row Level Security (RLS) policies
  • Passwords are hashed and never stored in plain text
  • Payment credentials are stored in encrypted environment variables, not in the database
  • Admin access requires multi-factor authentication

Cross-border transfer: By using TableFlow, you consent to your personal information being transferred to and stored in the European Union for the purpose of providing the service, in accordance with POPIA Section 72.

Third-Party Service Providers

We share limited personal information with the following trusted third-party service providers solely for the purpose of delivering our service:

  • Supabase — database hosting and authentication
  • Ozow — payment processing for customer meal payments
  • Capitec Bank — receipt of subscription payments via EFT

All third-party providers are contractually required to protect your personal information and may only use it for the specific purpose for which it was shared. We do not authorise any third party to use your personal information for their own marketing purposes.

Your Rights Under POPIA

As a data subject under the Protection of Personal Information Act 4 of 2013, you have the following rights:

  • Right of access — you may request a copy of the personal information we hold about you.
  • Right to correction — you may request that we correct inaccurate or incomplete personal information.
  • Right to deletion — you may request that we delete your personal information, subject to our legal retention obligations.
  • Right to object — you may object to the processing of your personal information in certain circumstances.
  • Right to lodge a complaint — you have the right to lodge a complaint with the Information Regulator of South Africa if you believe your rights have been violated.

Data Retention

We retain personal information for as long as is necessary to fulfil the purposes for which it was collected, or as required by law:

  • Restaurant account data is retained for the duration of the subscription and for 5 years thereafter for accounting and legal purposes.
  • Order data is retained for 3 years for operational and audit purposes.
  • Customer session data (table orders) that does not include identifying information is retained for 12 months.
  • When a Restaurant account is deleted, associated personal data is anonymised or deleted within 30 days, unless retention is required by law.

Cookies & Tracking

The TableFlow platform uses minimal browser storage (sessionStorage and localStorage) solely for functional purposes such as maintaining your session, storing cart items, and remembering your table number. We do not use advertising cookies or third-party tracking technologies.

We do not use Google Analytics, Meta Pixel, or any other behavioural tracking tool.

Children's Privacy

The TableFlow platform is intended for users who are 18 years of age or older. We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has provided us with personal information, please contact us immediately and we will delete that information.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify Restaurants of material changes via email at least 14 days before the changes take effect. The effective date at the top of this document will always reflect the most recent update.

Refund & Cancellation Policy

This policy governs refunds and cancellations on the TableFlow platform for both meal orders placed by customers and subscription fees paid by restaurants. TableFlow operates a two-sided platform — the rules differ depending on whether you are a Customer ordering food or a Restaurant subscribing to the service.

Part A
Meal Order Refunds — Customer Policy

Responsibility for refunds

All refunds relating to meal orders — including incorrect orders, unsatisfactory food quality, missing items, or orders not delivered — are the sole responsibility of the Restaurant from which the order was placed. TableFlow is a technology platform and is not a party to the transaction between the Customer and the Restaurant.

Important: If you have a complaint about your meal, please speak directly to the Restaurant's staff or manager. TableFlow does not process meal refunds and cannot intervene in disputes between Customers and Restaurants.

When a Customer may be entitled to a refund from the Restaurant:

  • The order was incorrect (different items delivered than ordered)
  • Items included in the order were not delivered
  • The food was of an unacceptable quality or was inedible
  • The Restaurant was unable to fulfil the order after payment was made

How to request a refund from the Restaurant:

  1. Speak to the Restaurant manager or staff at the time of the issue
  2. If unresolved, contact the Restaurant directly using their contact details
  3. Retain your order reference number (shown in the TableFlow app) as proof of purchase

Cancelled orders

Once a meal order has been submitted and payment has been processed, the order is immediately transmitted to the Restaurant's kitchen. Cancellation after payment is at the Restaurant's discretion. Customers are encouraged to review their order carefully before confirming payment.

Payment gateway disputes

If a payment was deducted from your account but the order was not confirmed, or if you were charged incorrectly, please contact us at info@coetzeedataconsultants.co.za with your order reference and we will assist in liaising with the payment gateway.

Part B
Restaurant Subscription — Cancellation & Refund Policy

Monthly subscription fees

TableFlow subscriptions are billed monthly in advance. The following policy applies to all Restaurant subscribers:

  • Free trial: All new Restaurants receive a 30-day free trial. No payment is required during the trial period. You may cancel at any time during the trial without any charge.
  • Monthly billing: After the trial, subscriptions are billed monthly. Payment is due on the date specified on your invoice.
  • No pro-rata refunds: Subscription fees are non-refundable once the billing period has commenced. If you cancel mid-month, you retain access until the end of the paid period. No partial refunds are issued.
  • Cancellation: You may cancel your subscription at any time by contacting us at info@coetzeedataconsultants.co.za. Cancellation takes effect at the end of your current billing period.
  • Non-payment: If payment is not received within 7 days of the due date, your account will be suspended. See Section 7 of the Terms and Conditions for the full access control policy.

Example: If your subscription renews on 1 June and you cancel on 15 June, you will retain access until 30 June. No refund will be issued for the unused portion of June. From 1 July, you will no longer be billed.

Exceptions — when refunds may be considered:

The Operator may, at its sole discretion, issue a refund or credit in the following exceptional circumstances:

  • A billing error resulted in a duplicate or incorrect charge
  • The Platform experienced a verified outage of more than 72 consecutive hours that prevented normal use
  • A new Restaurant was charged before their free trial period had expired

To request a refund under an exceptional circumstance, contact us within 14 days of the charge at info@coetzeedataconsultants.co.za with your invoice number and the reason for your request. All requests are reviewed within 7 business days.

Data after cancellation

Upon cancellation of your subscription, your Restaurant's data (menu, orders, staff) will be retained for 30 days to allow for reactivation. After 30 days, your data will be permanently deleted from our systems. You may request an export of your data before deletion by contacting us.

Part C
Consumer Protection Act Compliance

This policy is designed to comply with the Consumer Protection Act 68 of 2008 (CPA) of South Africa. To the extent that any provision of this policy conflicts with the CPA, the provisions of the CPA shall prevail.

Customers who are consumers as defined in the CPA retain all rights afforded to them under that Act, including the right to fair value, good quality, and safe food and service from the Restaurant.
